CAD Mis-Typing Leads to Federal Lawsuit

A father and son have filed a federal civil lawsuit against the Murfreesboro (Tenn.) police department, including dispatcher Desir’ Thorpe, alleging police entered their home illegally, and eventually arrested them on weapons charges. According to the lawsuit filed by Justin and Roger Chilton, Thorpe fielded a hang-up 911 call in Feb. 2009 from apartment #304 on North Rutherford Blvd. However, the lawsuit claims, Thorpe typed “South Rutherford Blvd.” into the CAD system, whch sent officers to the wrong apartment. When officers arrived, the Chiltons say officer banged on the door at 3:30 a.m., but failed to identify themselves, even after Justin asked who was at the door. The officers eventually entered, confronted the two men and arrested them, “after they became aware of the mistake” in location, the lawsuit states. The lawsuit claims battery and unlawful use of force, negligence, intentional and negligent infliction of emotional distress, and false imprisonment.
