Lawsuit Filed, 911 Tape Released in Murder Case

Madison (Wisc.) police have released an edited logging tape of a 911 call made by the boyfriend of Brittany Zimmermann last April when he came home to discover she had been shot to death. The call came about an hour after someone at the apartment in Madison called 911, but the call was cut off. Dane County dispatcher Rita Gahagan answered the first call, but failed to call the number back or send police, sparking legal actions and community debate over how the call was handled. Several sources say there are sounds on the tape indicating a struggle. This week Zimmermann’s family filed a third lawsuit against the county, Gahagan and county exec Kathleen Falk, alleging negligence and wrongful death. The two previous lawsuits were directed at the county and the apartment building owner. A county judge ruled last year that police had the right to withhold the logging tape of the first call, and it has not been released.
