In an unusual move, the family of Brittany Zimmermann has asked a federal court to dismiss the lawsuit they filed earlier against Dane County and dispatcher Rita Gahagan in connection with the April murder of their daughter. The lawsuit claimed that the county and Gahagan were negligent in the handling of a 911 call that came from Zimmermann’s apartment before she died, and for mismanagement of the center. County officials say that no settlement has been made with the family, but neither side would provide the reason for the family’s dismissal request. Police were not dispatched in response to the 911 call, and Zimmermann was found dead several hours later. County officials didn’t reveal the 911 call until questioned by reporters several days after the incident.
