County Files Answer to Federal Lawsuit

Attorneys for Dane County (Wisc.) and former dispatcher Rita Gahagan have filed a formal request to dismiss a federal lawsuit filed by the family of Brittany Zimmermann, who was murdered last April in her apartment. Someone at the apartment placed a 911 call that last 90 seconds, the call ended for an unknown reason, but Gahagan did not call back or create an incident for police to investigate. In its request, the attorneys cited previous court cases that held municipalities don’t have a duty to rescue persons in distress. They also argued that Gahagan did not act “recklessly, intentionally, and in bad faith” as alleged in the family’s lawsuit. Download (pdf) a copy of the lawsuit response here.
