County Appeals Reinstatement–Again

Athens County (Ohio) commissioners have filed an appeal with the state Supreme Court over a lower court’s ruling that they should reinstate Warren Ferguson, whom they fired in 2005 for sexual harassment and on-duty alcohol abuse. An arbitrator ruled last year that Ferguson was considered a “troubled” employee with medical and other problems, and should not have been fired. However, the county has refused to hire him back, and now will appeal a lower courts ruling that agreed with the arbitrator. Download (pdf) the county’s filing with the Supreme Court, and the Ohio Patrolmen’s Benevolent Association’s response here.
