A New Jersey appellate court has ruled that a family’s lawsuit against the Camden police and former dispatcher Marie Cupparo can proceed. Christine Eberle, 27, died in 2001 after being kidnapped from a transit station. A witness dialed 911 and reported the kidnapping, but Eberle’s family alleged that Cupparo failed to dispatch officers to the incident. The family says Eberle could have been saved by a prompt response. The 3-judge panel ruled that the defendants were not immune from lawsuits in the case, since Cupparo wasn’t involved in making policy decisions at the time, an activity protected by state law.
