City Settles With Sleeping Dispatcher

The Salem (Ore.) city council has settled a disability-related lawsuit with former dispatcher Jon R. Brown for $35,000. Brown was fired in 2003, according to the city because of missing calls, performing non-city work while on-duty, and for falling asleep twice. But Brown said the firing was retaliation for his filing labor complaints with management. Brown sued under the Americans With Disabilities Act (AD), claiming he suffers from sleep apnea, which forced him to take “micro sleeps” during work. the lawsuit said the city refused to accommodate his disability, such as exempting him from night shifts.
