The FCC has issued an Order declaring that public safety agencies may disclose information from the 800 MHz rebanding agreements they sign with Sprint, despite non-disclosure provisions that Sprint has included in the agreements. The FCC said that allowing the disclosure of the agreement information, “will facilitate the rebanding process and is necessary to the conduct of good faith negotiations as required by the Commission.” They said that future agreements should allow for disclosure, but that existing agreements won’t be re-opened and re-negotiated.
